1. Agreement to Terms

Welcome to SongFinder. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SongFinder ("we," "us," or "our") governing your access to and use of our music recognition service, operated from Morocco, website, and related services (collectively, the "Service").

By accessing or using SongFinder, you agree to be bound by these Terms.By accessing or using SongFinder, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Service.

You represent that you are at least 13 years of age. If you are under 18, you represent that you have obtained parental or guardian consent to use this Service.

2. Service Description

SongFinder is a free music recognition and audio tools platform that allows users to:

• Upload audio or video files for song identification
• Record live audio through their device's microphone
• Access AI-powered audio processing features including vocal removal, noise removal, and reverb removal (server-side processing)
• Receive song metadata including title, artist, album, and related information
• Use browser-based audio tools including an audio trimmer, audio mixer with multi-lane DAW-style timeline, speed and pitch changer, BPM detector, key detector, and mood detector (client-side processing, no data uploaded)

The Service is provided "as-is" and may be modified, updated, or discontinued at any time without prior notice.

3. User Accounts and Responsibilities

3.1 Account Creation

Currently, SongFinder does not require account registration for basic use. However, we may introduce account features in the future. If implemented, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 User Responsibilities

You are responsible for:

• Ensuring you have the right to upload or process any audio content
• Your internet connection and any associated costs
• All activity that occurs through your use of the Service
• Complying with all applicable laws and regulations
• Respecting the intellectual property rights of content creators

4. Acceptable Use Policy

You agree NOT to engage in any of the following prohibited activities:

• Using the Service for any unlawful purpose or in violation of any laws
• Harassing, threatening, or intimidating others
• Attempting to gain unauthorized access to our systems, servers, or databases
• Sending spam or creating fake accounts

• Uploading files containing viruses, malware, or harmful code
• Creating multiple accounts to evade restrictions or selling accounts

4.2 Service-Specific Prohibitions

• Excessive or automated requests that burden our infrastructure (DDoS attacks)
• Using bots, scrapers, or automated tools without permission
• Bypassing usage quotas, rate limits, or access restrictions
• Using SongFinder for commercial purposes without authorization
• Reselling recognition results or integrating into commercial products
• Harvesting recognition results for databases or derivative works
• Using the Service to facilitate piracy or illegal distribution
• Attempting to reverse engineer our algorithms or technology
• Recording or uploading audio of individuals without consent
• Deliberately consuming excessive server resources

4.3 Inappropriate Content

Zero-tolerance policy for:

• Child exploitation material (immediate ban and law enforcement notification)
• Terrorism-related content
• Credible threats of violence
• Content depicting graphic violence or gore
• Audio recordings obtained through illegal surveillance

4.4 Consequences of Violations

Violations may result in:

• First-time minor violations
• 7-30 days for repeated or moderate violations
• Severe violations or repeated offenses
• Attempts to circumvent account bans
• Criminal activities, severe abuse, or significant damages
• We preserve data and cooperate with authorities when legally required

5. Intellectual Property Rights

5.1 Our Intellectual Property

SongFinder and all related content, features, and functionality (including but not limited to software, algorithms, text, graphics, logos, and design) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, distribute, or create derivative works from our Service
• Reverse engineer, decompile, or disassemble our software or algorithms
• Remove or alter any copyright, trademark, or other proprietary notices
• Use our name, logo, or branding without written permission

5.2 Trademarks

"SongFinder" and our logo are trademarks. Unauthorized use of these marks is strictly prohibited.

5.3 Third-Party Content

Song metadata, album artwork, and artist information are provided by third-party services and music rights holders. We do not claim ownership of this content.

6. User-Submitted Content

6.1 Audio Files and Recordings

By uploading or recording audio through our Service, you represent and warrant that:

• You own the rights to the audio or have obtained necessary permissions
• The content does not violate any third-party rights
• The content complies with our Acceptable Use Policy

6.2 License Grant

You grant us a limited, non-exclusive, royalty-free license to process your submitted audio solely for the purpose of providing recognition and AI audio processing services. This license terminates when your audio is automatically deleted from our servers (typically within minutes of processing). This license grant applies only to features that require server-side processing (song recognition, vocal removal, noise removal, reverb removal).

For browser-based tools (audio trimmer, audio mixer, speed and pitch changer, BPM detector, key detector, mood detector), no license grant is necessary as your files are processed entirely on your device and are never transmitted to our servers.

6.3 Data Deletion

As stated in our Privacy Policy, all uploaded audio files for server-side processing are automatically deleted immediately after processing. We do not permanently store your audio content. Files used in browser-based tools never leave your device and are discarded when you close or refresh the page.

6.4 Copyright Complaints

We respect intellectual property rights. While we strive for high accuracy, music recognition is not 100% accurate. We do not guarantee:

• Correct identification of all songs
• Availability of metadata for all tracks
• Recognition of obscure, regional, or newly released music

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SONGFINDER AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, special, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to your data
• Interruption or cessation of the Service
• Errors, omissions, or inaccuracies in recognition results
• Third-party content, advertisements, or linked websites
• Any damages exceeding $100 USD in aggregate

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless SongFinder, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

12. Termination and Suspension
